INVITATION TO SUBMIT INTEREST FOR ELECTION TO:

 iii.      APPEAL COMMITTEE

 

1.                  Submission of Interest

 

1.1       Notice is hereby given for submission of interest by Singapore Citizens or Singapore Permanent Residents for the election of the Chairperson, Deputy Chairperson and member(s) to the Audit and Compliance Committee, Electoral Committee, Electoral Appeal Committee and Judicial Bodies namely the Disciplinary Committee, Ethics Committee and Appeal Committees for the term 2017 – 2021.

 

1.2       The interest submitted shall be considered by the Executive Committee of the Football Association of Singapore (FAS) and suitable candidates may be elected on an en bloc basis by the Congress upon proposal of the Executive Committee. At the request of at least ten Ordinary Members, however, a separate vote for a specific candidate shall take place (Article 28.22).

 

1.3       The finalised list of candidates proposed for the respective elections shall be made known by the FAS at least ten (10) days before the date of the Congress, along with the details of the FAS Annual Congress.

 

1.4       All Chairpersons, Deputy Chairpersons and member(s) of the Audit and Compliance Committee, Electoral Committee, Electoral Appeal Committee and Judicial Bodies (Disciplinary, Ethics and Appeal Committees) are elected by the Congress of FAS for a period of four (4) years and for the avoidance of doubt, the period of four (4) years shall commence from the date of this election (Article 44.4, 46.3 and 49.4 of the FAS Constitution).

 

2          Details of the Committees are as follows:

 

2.1       Audit and Compliance Committee

Composition

Up to Five (5) and a minimum of Three (3) including the Chairperson and Deputy Chairperson.

 

Criteria

The Chairperson and Deputy Chairperson of the Audit and Compliance Committee shall be independent. They shall not be considered independent if, at any time during the four years preceding their terms, they or any family member (spouse, children, stepchildren, parents, siblings, related parties, parents of spouse/related parties and siblings and children of related parties):

 

a) held any paid position or material contract (directly or indirectly) with     

    FAS and or any member/Confederation, League or Club (including any of

    their affiliated companies / organisations);

 

b) was employed by FAS’s outside legal counsel or by FAS’s auditor (and

    was engaged in auditing FAS);

 

c) held any paid or voluntary position with a non-profit organisation to which

    FAS and/or any Member, Confederation, League or Club makes annual

    payments in excess of USD 100,000.

 

Article 44.5 of the FAS Constitution refers.

 

Roles

The Audit and Compliance Committee shall ensure the completeness and reliability of the financial accounting and review the financial statements, the consolidated financial statement and the external auditors’ reports.

 

The Audit and Compliance Committee shall advise and assist the Council in monitoring the Association’s financial and compliance matters, and issue and monitor compliance with the relevant regulations of the Association.

Integrity Checks

The integrity check for the candidates for the offices of the Chairperson, Deputy Chairperson and members of the Audit and Compliance Committee shall be conducted by the Ad Hoc Electoral Committee.

2.2       Electoral Committee

Composition

The Electoral Committee shall be composed of a Chairperson, Deputy Chairperson and one member.

 

Article 46.1 of the FAS Constitution refers.

 

Criteria

All members of the Electoral Committee shall be independent. They shall not be considered independent if, at any time during the four years preceding their terms, they or any family member (spouse, children, stepchildren, parents, siblings, related parties, parents of spouse/related parties and siblings and children of related parties):

 

a) held any paid position or material contract (directly or indirectly) with   

    FAS and or any member/Confederation, League or Club (including any of

    their affiliated companies / organisations);

 

b) was employed by FAS’s outside legal counsel or by FAS’s auditor (and

    was engaged in auditing FAS);

 

c) held any paid or voluntary position with a non-profit organisation to which

    FAS and/or any Member, Confederation, League or Club makes annual

    payments in excess of USD 100,000.

 

Articles 44.5 and 46.5 of the FAS Constitution refers.

 

Roles

The Electoral Committee shall supervise the administrative process relating to the elections of FAS and monitor compliance with the Constitution and the FAS Electoral Code as well as any other guideline as required in the performance of its duties. Furthermore, the Electoral Committee shall carry out the integrity checks for all that are subject to it. These and further duties and responsibilities of the Electoral Committee shall be stipulated in the FAS Electoral Code.

 

Article 46.4 of the FAS Constitution refers.

 

Integrity Checks

The integrity check for the candidates for the offices of the members of the Electoral Committee shall be conducted by the Ad Hoc Ethics Committee.

2.3       Electoral Appeal Committee

Composition

The Electoral Appeal Committee shall be composed of a Chairperson, Deputy Chairperson and one member.

Criteria

All members of the Electoral Appeal Committee shall be independent. They shall not be considered independent if, at any time during the four years preceding their terms, they or any family member (spouse, children, stepchildren, parents, siblings, related parties, parents of spouse/related parties and siblings and children of related parties):

 

a) held any paid position or material contract (directly or indirectly) with   

    FAS and or any member/Confederation, League or Club (including any of

    their affiliated companies / organisations);

 

b) was employed by FAS’s outside legal counsel or by FAS’s auditor (and

    was engaged in auditing FAS);

 

c) held any paid or voluntary position with a non-profit organisation to which

    FAS and/or any Member, Confederation, League or Club makes annual

    payments in excess of USD 100,000.

Roles

The Electoral Appeal Committee shall examine the appeal(s) against decisions of the Electoral Committee regarding the eligibility of candidates.

 

Integrity Checks

The integrity check for the candidates for the offices of the members of the Electoral Appeal Committee shall be conducted by the Ad Hoc Ethics Committee.

2.4       Judicial Bodies are:

            a)         the Disciplinary Committee;

            b)         the Ethics Committee;

            c)         the Appeal Committee.

 

Composition of each Judicial Body

1. The Disciplinary Committee

The Disciplinary Committee shall consist of a Chairperson, a Deputy Chairperson and a specific number of other members deemed necessary by the Executive Committee which is up to Twelve (12) and a minimum of Three (3) including the Chairperson and Deputy Chairperson.

 

Article 49.2 of the FAS Constitution refers.

 

2. The Ethics Committee

The Ethics Committee shall consist of a Chairperson, a Deputy Chairperson and a specific number of other members deemed necessary by the Executive Committee which is up to Five (5) and a minimum of Three (3) including the Chairperson and Deputy Chairperson.

 

Article 49.2 of the FAS Constitution refers.

 

3. The Appeal Committee

The Appeal Committee shall consist of a Chairperson, a Deputy Chairperson and a specific number of other members deemed necessary by the Executive Committee which is up to Five (5) and a minimum of Three (3) including the Chairperson and Deputy Chairperson.

 

Article 49.2 of the FAS Constitution refers.

 

Criteria for all Judicial Bodies

i. The Judicial Bodies are to be composed in such a way that the members, together, have the knowledge, abilities and specialist experience that is necessary for the due completion of their tasks (Article 49.3 refers).

 

ii. The Chairpersons and Deputy Chairpersons of the Judicial Bodies shall be qualified to practise law (Article 49.3 refers).

 

iii. The Chairpersons, the Deputy Chairpersons and other members of the Judicial Bodies shall not be members of the Executive Committee or of a Standing Committee.

 

iv. All members of the Judicial Bodies shall be independent. They shall not be considered independent if, at any time during the four years preceding their terms, they or any family member (spouse, children, stepchildren, parents, siblings, related parties, parents of spouse/related parties and siblings and children of related parties):

a) held any paid position or material contract (directly or indirectly) with   

    FAS and or any member/Confederation, League or Club (including any of

    their affiliated companies / organisations);

 

b) was employed by FAS’s outside legal counsel or by FAS’s auditor (and

    was engaged in auditing FAS);

 

c) held any paid or voluntary position with a non-profit organisation to which

    FAS and/or any Member, Confederation, League or Club makes annual

    payments in excess of USD 100,000.

 

Articles 44.5 and 49.3 of the FAS Constitution refers.

 

Roles of each Judicial Body

The following are the key roles of each of the Judicial Bodies:

 

a) Disciplinary Committee shall oversee, evaluate and decide on disciplinary cases in accordance with the regulation of FAS and to pronounce sanctions provided in the regulation.

 

b) The function of the Ethics Committee shall be governed by the relevant regulation of FAS and to pronounce sanctions described in the Constitution and the relevant regulation of FAS.

 

c) The function of the Appeal Committee shall be governed by the relevant regulation of FAS. The Appeal Committee is responsible for hearing appeals against decisions from the Disciplinary Committee and the Ethics Committee that are not declared final by the relevant regulations of FAS.

 

Integrity Checks

The integrity check for the candidates for the offices of the Chairperson, Deputy Chairperson and members of the Judicial Bodies shall be conducted by the Ad Hoc Electoral Committee.

3.         Collection of Forms and Documents

 

3.1       The following documents can be collected at the FAS General Secretariat (located at Jalan Besar Stadium, 100 Tyrwhitt Road, #01-02, Singapore 207542) between 12 October 2017 and 19 October 2017, between the hours of 9.00am to 6.00pm or downloaded from the FAS website at  www.fas.org.sg/news/congressdocs2017:

 

i) Form 1A: Audit and Compliance Committee

ii) Form 1B: Electoral Committee and Electoral Appeal Committee  

iii) Form 1C: Judicial Bodies (Disciplinary, Ethics and Appeal Committees)   

iv) Form 2: Declaration of Integrity

 

4.         Submission of Forms and Documents

 

4.1       Candidates shall submit the following completed Forms and documents:

 

i) Forms 1A, 1B or 1C

ii) Form 2 (Declaration of Integrity)

iii) Copy of NRIC (Front & back)

iv) Copy of Passport (Passport details page)

iv) A Recent Coloured Passport Size Photograph

v) Detailed Curriculum Vitae relevant to the committee interested in (to include personal details, work experience, academic qualifications)

 

4.2       All forms and documents must be completed and delivered by hand to the FAS General Secretariat, 100 Tyrwhitt Road #01-02, Jalan Besar Stadium, Singapore 207542, in exchange for acknowledgement of receipt, no later than 6pm, Thursday, 19 October 2017.

 

5.         Operating Hours

 

5.1       For the purposes of this election, in particular, the collection and submission of all forms shall be done at the FAS General Secretariat, which will operate from 9.00am to 6.00pm daily including Saturdays and Sundays where necessary.

 

6.         Correspondence

 

6.1       All queries relating to the election of the FAS Audit and Compliance Committee, Electoral Committee, Electoral Appeal Committee and Judicial Bodies shall be forwarded to the FAS General Secretariat at congress@fas.org.sg.
